Terms of Service

1. About these terms

These Terms of Service (“Terms”) govern your purchase and use of remote ECU tuning services from SamuelTuned (“we”, “us”). By placing an order or sending a brief, you agree to these Terms. If you do not agree, do not place an order.

These Terms do not affect your statutory rights as a consumer under the Consumer Rights Act 2015. Where these Terms conflict with non-excludable consumer rights, the statutory rights prevail.

2. The service

We provide remote ECU and TCU tuning for BMW vehicles via Bootmod3, MHD, MG Flasher and xHP. The deliverable is a calibrated map (a tune file) emailed to you, plus hand-over briefing and post-flash support. Tuning is hand-calibrated — never automatically generated.

3. Order formation

  • An order is placed by completing the configurator, paying via Stripe, and receiving an order confirmation email.
  • We reserve the right to refuse, cancel or refund any order — for example if your build is incompatible with the selected stage, your VIN cannot be verified, or the vehicle is in a restricted jurisdiction (e.g. California for emissions-affecting tunes).
  • A completed Stripe payment is the offer; our written acceptance (typically by email confirming we are starting calibration) forms the binding contract.

4. Pricing

  • Prices on the configurator are previewed in GBP and recomputed server-side at checkout. Stripe applies VAT, EU OSS, UAE and other tax as required.
  • Stage 3 turbo upgrades and certain large-build packages are quoted via consultation rather than configurator pricing — you will receive a written quote before any payment is taken.
  • Prices may change at any time. The price you pay is the price displayed at checkout.

5. Delivery

  • Tune files are delivered manually by email by Samuel, typically within 24 hours of payment confirmation, sometimes longer for complex builds. We do not use automated delivery — every file is reviewed by Samuel before being sent.
  • We may request additional information (VIN, hardware setup, datalogs) before delivering the file. Delays caused by missing information do not extend our liability or trigger refund.
  • You are responsible for licensing the platform on your VIN (Bootmod3 / MHD / MG Flasher) before flashing. We do not supply platform licences.

6. Customer obligations

By placing an order you confirm:

  • You are 18 or over and the legal owner of the vehicle (or are authorised by the owner).
  • You have read and accept the Refund and ECU Modification Disclaimer.
  • Your vehicle and use case are compliant with the laws of your jurisdiction. You are solely responsible for confirming that the modification is legal where you drive.
  • Information you provide (VIN, fuel grade, hardware) is accurate. Inaccurate information that causes a misfit map is not refundable; we will rework the file if practical, but at our discretion.

7. Refunds and the digital-content right of withdrawal

Tune files are bespoke digital content created for your specific VIN. Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 reg. 37(1)(a) and the EU Consumer Rights Directive Art. 16(m), the right of withdrawal is forfeited once delivery of the digital content has begun, with your prior express consent and acknowledgement that you thereby lose your withdrawal right.

In practice, this means: once we have started calibrating your file, the order is non-cancellable. If we have not yet started, you may cancel for a full refund.

Faulty files are remediable: if the delivered file does not match your build or has a defect, we will rework it free of charge until it does. See the Refund and ECU Modification Disclaimer for full detail.

8. Warranty and fitness

We warrant that the tune file we deliver is fit for the build you described and will be calibrated using reasonable skill and care to industry-standard practice. We do not warrant any specific power, torque, fuel-economy or lap-time outcome — actual figures depend on your hardware, fuel quality, environmental conditions, and driving.

The tune file is provided “as-is” for off-road / private-property / your-own-risk use unless your jurisdiction expressly permits its use on public roads. The manufacturer warranty on your vehicle is likely to be voided by ECU modification — see the Refund and ECU Modification Disclaimer.

9. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

Subject to the above:

  • Our total liability to you in connection with any single order is limited to the amount you paid us for that order.
  • We are not liable for indirect or consequential losses, including but not limited to: vehicle damage caused by hardware fault, incompatible modifications, fuel quality, driver behaviour, or third-party flashing tools; loss of profit; loss of use; loss of opportunity.
  • We are not liable for fines, prosecutions or insurance consequences arising from using the tune in jurisdictions where it is not road-legal.

10. Disputes and chargebacks

If you have a problem, contact us first — we resolve almost everything by email or WhatsApp without need for any formal process. We track our dispute rate (target below 0.65% of orders).

Frivolous chargebacks for delivered files will be defended with evidence including order metadata, delivery confirmation, and your acceptance of these Terms.

11. Intellectual property

The tune file is licensed to you for use on the specific VIN you ordered for. You may not redistribute, resell, copy, reverse-engineer, or use the file on any other vehicle. The tune file remains our intellectual property; the licence is non-transferable.

12. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the version in effect at the time of order. Material changes will be communicated in advance for active customers.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except where a non-excludable consumer right grants you the option to sue in the courts of your country of residence.
